Yasal durum

Oyuncak Yönetmeliği , 2009 tarihli Oyuncak Direktifi yerine geçmektedir. 12 Aralık 2025 tarihinde yayınlanan yönetmelik, 1 Ocak 2026 tarihinden itibaren yürürlüğe girmiştir. Uygulamada karşılaşılan en büyük üç engel

  1. Pasaport, halihazırda sahip olduğunuz beyanın ötesinde bir şeydir. Uygunluk beyanı, bir kez imzalanmış bir sayfadır. Pasaport ise kimlik bilgisi, üretici, uygunluk beyanı, standartlar ve koku maddelerini sabit bir yapı içinde barındırır. Bir gümrük sistemi, insan müdahalesi olmadan bu bilgileri okur. Mevcut beyanlarınız iyi bir ilk taslaktır.
  2. Kimya sektörü sürekli değişmektedir. Yeni yönetmelik, eskisine göre daha fazla maddeyi yasaklamaktadır; bunların arasında PFAS ve belirli bisfenoller de bulunmaktadır. Madde listesi, yetki devri yoluyla genişletilebilir. Her güncelleme, halihazırda piyasada bulunan ürünleri etkiler.     Oyuncak Yönetmeliği Yayınlandı

    Oyuncakların güvenliğine ilişkin (AB) 2025/2509 sayılı Tüzük Resmi Gazete’de yayımlandı. Bu Tüzük, 2009/48/EG sayılı Oyuncak Direktifi’nin yerini almaktadır. Direktifin ulusal düzeyde uygulanmasına ilişkin düzenlemeler, tek bir, doğrudan geçerli olan mevzuat çerçevesine dönüştürülmüştür.

  2. 1 Ocak 2026
    Yürürlüğe girdi ve geçiş süresi başladı

    Yönetmelik yürürlüğe girer. Bildirilen kuruluşlara, Komisyonun yetkilerine ve yaptırımlara ilişkin kurallar bu tarihten itibaren geçerli olur. Raflardaki oyuncaklar açısından ise henüz bir değişiklik olmaz.

  3. 20 Temmuz 2026
    AB-DPP Kayıt Sistemi devreye giriyor

    ESPR’nin merkezi kaydı, test ortamı da dahil olmak üzere faaliyete geçiyor. Uygulama Tüzüğü (AB) 2026/1778, bu kaydın işleyişini düzenlemektedir. Oyuncak pasaportları da, piyasaya sürülmeden önce ürün ve paydaş kimlik bilgileriyle birlikte buraya kaydedilecektir.

  4. 1 Ağustos 2029
    Küçük ölçekli üreticiler için kılavuzlar

    Komisyon, en geç şimdi küçük ve orta ölçekli işletmelere kılavuzlar sunuyor. Bu kılavuzlar, oyuncak pasaportunun nasıl oluşturulacağını ve yönetileceğini gösteriyor. Bu, zorunluluğun yürürlüğe girmesinden bir yıl önce gerçekleşiyor.

    Yönetmelik şu durumlarda geçerlidir

    Bu tarihten itibaren bir oyuncağın piyasaya sürülebilmesi için dijital ürün pasaportunun bulunması zorunludur. Bu pasaport, eski direktifin AB uygunluk beyanının yerini almaktadır. Oyuncakta, ambalajda veya beraberindeki belgelerde bulunan bir veri taşıyıcısı aracılığıyla erişilebilir.

    Eski stoklar pazar paylarını koruyor

    Bu tarihten önce 2009/48/EG sayılı Direktif uyarınca yasal olarak piyasaya sürülmüş oyuncaklar, süre sınırlaması olmaksızın satışa sunulmaya devam edilebilir. Ayrım, piyasaya sürülme anında yapılır. Tüketicilere satış bu konuda dikkate alınmaz.

  7. 1 Şubat 2031
    Eski tip onay belgelerinin geçerlilik süreleri doluyor

    2009/48/EG sayılı Direktif uyarınca düzenlenmiş AT tip onayı sertifikaları, daha önce geçerlilik süreleri dolmadığı sürece bu tarihe kadar geçerliliğini korur. Bu tür bir sertifikaya dayananlar, yeni değerlendirmeyi bu tarihten önce planlamalıdır.

Satış öncesinde Article 10(2), Regulation (EU) 2025/2509Before making a toy available on the market, distributors shall verify that the following conditions have been met: (a) the toy is accompanied by instructions for use and safety information in accordance with Article 7(7) and bears warnings in accordance with Article 6 in a language or languages which can be easily understood by consumers or other end users as determined by the Member State in which the toy is to be made available on the market; (b) the data carrier is affixed in accordance with Article 19(7); (c) the CE marking is affixed in accordance with Article 18(1); and (d) the manufacturer and the importer have complied with the requirements set out in Article 7(2), second subparagraph, and Article 7(5), (6) and (12) and in Article 9(4), respectively.. Malzeme güvenliği

Yönetmelik, ağır metaller, plastikleştiriciler, alerjenik koku maddeleri ve nikel için sınır değerler ve yasaklar belirlemektedir. Ayrıca Annex II, Part III, points 4 to 6, Regulation (EU) 2025/25094. The presence in toys, components of toys or micro-structurally distinct parts of toys of substances in the form classified in Part 3 of Annex VI to Regulation (EC) No 1272/2008 in any of the following categories is prohibited: (a) carcinogenicity, germ cell mutagenicity or reproductive toxicity (CMR) category 1A, 1B or 2; (b) endocrine disruption for human health category 1 or 2; (c) specific target organ toxicity category 1, either in single exposure or in repeated exposure; (d) respiratory sensitisation category 1; (e) skin sensitisation category 1A. 5. The intentional use in toys, components of toys or micro-structurally distinct parts of toys, of per- and polyfluoroalkyl substances (PFAS) is prohibited. 6. The presence in toys, components of toys or micro-structurally distinct parts of toys, of the bisphenols included in Part D of the Appendix is prohibited.. Transpareo, oyuncak üreticileri ve ithalatçıları için geliştirilmiş bir DPP yazılımıdır. Yönetmelikte belirtilen içerik öğelerini, tek seferlik olarak ayrı alanlar halinde oluşturursunuz.
